Case law

These pages contain important court judgments in Judicial Review cases relating to the Criminal Injuries Compensation Schemes. A judgment is the official record of the court hearing giving the decision and the reasons for it. The Tribunal and the Criminal Injuries Compensation Authority must take account of any relevant Judicial Review decisions when they decide claims under the Criminal Injuries Compensation Scheme.

The judgments are set out under three headings – Eligibility, Assessment and Procedure

Each judgment is introduced by a short paragraph explaining the issues, the relevant paragraphs of the Scheme and a reference to the law reports in which the full judgment is reported. This is to help you identify any judgments relevant to the facts of your case. It does not form part of the judgment itself. The main body of the judgment is an official document and uses legal language. We cannot change this.
